Alternative Dispute Resolution offers parties the opportunity to resolve disputes without resorting to protracted litigation. The various forms of ADR can offer significant advantages over the court process by being faster, less expensive and more flexible. A number of courts have recognised these advantages and courts are now increasingly referring matters to mediation, in particular.

In contrast to court proceedings, which are open to the public, the mediation process is private and confidential and conducted on a "without prejudice" basis. Anything said or produced in evidence at a mediation session cannot be used in a later hearing, except in exceptional circumstances.

The mediator's role is to help the parties and their advisors to reach a settlement of the dispute. How the mediator goes about this task varies from mediator to mediator and depends on the nature of the dispute.
